1.0 Racquet Depot Terms and Conditions
Please read this document carefully as it contains the terms and conditions that you agree to be bound by if you continue to use Racquet Depot. The terms and conditions below (“Terms and Conditions”) as well as the other four documents entitled "Privacy Policy", "Returns & Exchanges", "FAQs" and "Shipping Information" apply to your use of the Racquet Depot's services and to any purchases you make through Racquet Depot. In the event of any conflict between the Terms of Use and these Conditions, the latter shall prevail. These Conditions and the Terms of Use apply between you and Racquet Depot ("Racquet Depot", “we” or “us”). 1.5 Purchasing Racquet Depot Products
Eligibility to order criteria:
You may only purchase products:
- Available for sale and details of which appear on Racquet Depot.
- For personal use, either by yourself or by your intended recipient(s) of the products. Racquet Depot reserves the right to decline any order that it has reasonable cause to believe is for onward sale other than through distribution channels approved by Racquet Depot.
Details of the products available for purchase (including their price) are set out on Racquet Depot. Racquet Depot takes all reasonable care to ensure that all details, descriptions and prices of products appearing on Racquet Depot are correct at the time when the relevant information is placed onto Racquet Depot. Although every effort is made to keep Racquet Depot as up to date as possible, the information appearing at a particular time may not always reflect the true status when you place an order. Please look at the title of each product as this is what you are buying as the description, specification and delivery information are for reference only.
Ordering Products:
- Once you have selected the products you wish to order, click on the "View Basket” button at the end of the checkout process.
- Once you have clicked on the “View Basket” button and enter your details. We d take any of your credit card details on our site. Payment is taken on Paypal.
- Racquet Depot will E-mail you to confirm your product order has been received.
- Racquet Depot will E-mail you to confirm that the payment has been received.
- Racquet Depot will E-mail you to confirm that your order has been shipped.
- To view the status of your order you need to log in to your account at Racquet Depots website.
- A contract of sale for the products you have ordered is concluded between you and Racquet Depot only upon those products being shipped to you.
Racquet Depot may refuse or be unable to process your order if:
- If out of stock and on backorder. If this is the case the customer will be asked whether they would like to wait for the item(s) to arrive at our warehouse.
- The product you ordered is discontinued or no longer available.
- Your credit card does not give authorisation for the payment of the purchase price
- You not meeting the eligibility to order criteria set out at the beginning of this Section 1.5.
1.6 Cancelling the Contract and Returns
Should you wish to return or exchange a product bought from Racquet Depot, please follow the procedure:
1.7 Returns via a parcel carrier
Within 7 days of receiving the product, please:
- Login to your account at Racquet Depot and request to return the item(s). If we agree to the return, you can return the item(s), you should return the item(s) and you must follow the advice below.
We recommend you use a carrier that offers both traceability and insurance. You should obtain a receipt for the parcel when you send it.
- You will be refunded at the price you paid for the product at the time of your order if you receive the wrong item(s).
- You will be refunded the product price or exchange the product once the product is received by us at our warehouse. A refund of the delivery charge will not be given unless the products returned are incorrect or were delivered in a damaged or faulty state (in which case see paragraph “Incorrect orders and damaged or faulty products” below).
- Once the packaging of a product has been opened, then you will not be able to return the item(s) in any circumstances.
- Where you return the product to us via parcel carrier you will be given a refund for the item(s), however no postage costs will be returned in any circumstances. You must included your order number when returning items.
- It is the buyer's responsibility to pay all returns postage costs.
- A restocking fee of 20% of the item(s) value will be applied for all orders that are unwanted. All item(s) returned to us that are not incorrect, damaged or faulty will have the restocking fee applied.
Incorrect orders and damaged or faulty products
If you are returning an incorrect order or a product which was delivered to you in a damaged or faulty state, we would ask you to do the same as above. There will be no restocking fee and postage costs paid on our website will be returned. All return costs are subject to the buyers expense.
- Failure to return item(s) without any reference to your order number may result in no refund applied or fees taken of the cost paid on our website.
1.8 General
Racquet Depot reserves the right to:
- Modify or withdraw, temporarily or permanently, Racquet Depot (or any part thereof) with or without notice to you; Racquet Depot shall not be liable to you or any third party for any such modification or withdrawal; and/or
- Change the Conditions from time to time, and your continued use of Racquet Depot (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using Racquet Depot.
- If Racquet Depot should change these Conditions, your order will be subject to the Terms and Conditions at the Date and time of you placing your order. Copies of the appropriate terms and conditions are available by email from admin@racquetdepot.co.uk.
If any part of the Conditions is declared unlawful or unenforceable, then that provision shall be deemed deleted from the Conditions and the remaining provisions of the Conditions shall remain in full force and effect. English law applies to these Conditions and any dispute relating to the Conditions shall be settled by the English courts.
